137 participants took part in the public survey. It is dificult to repay a consumer credit for 68 participants, it is not dificult for 36 participants and 33 participants have not a consumer credit.

Examples outside FA jurisdiction

Examples of disputes the Financial Arbitrator is not authorised to address:

A transfer that took place prior to the effective date of the Act on Financial Arbitrator, i.e. until 2003.

On 13 December 2002, I lodged a multiple payment order with a branch of the institution, totalling to CZK 28 000 and due on the next day. I learned from my account statement that the payment order did not take place. There were sufficient funds at the account. The bank declined to admit my complaint.

A transfer of USD 15 000 (a currency outside EU and EC)

We learned from our account statement of February this year that, during the month, the institution debited the total of EUR 51 000 to our account with respect to payments made by a business debit card in Brussels. In our view, the institution used an incorrect FX rate at translating the amount into CZK. We complained forthwith about the applied rate but the institution claimed it used a correct rate.

A transfer in excess of EUR 50 000

Contractual terms and conditions

Following my application for a mortgage, an arrangement fee of CZK 7 000 was debited to my account. The institution turned down my complaint claiming it proceeded in line both with their Tariff and contractual terms in force.

An abused debit card outside EU and EC

During my holiday in Bangkok, my debit card was stolen from me and then abused to draw cash from ATMs and pay at a vendor. The institution turned down my complaint because the drawdowns occurred prior to blocking the card.

Insurance compensations with an insurance company

I have encountered a problem with the insurance company concerning the insurance compensations. I have had a car policy for CZK 250 000 of insured loss but after the car was stolen the insurance company have paid me only CZK 136 000. The company declined to admit my complaint on the basis that the car incomplied with the original policy according to the documents.
